Terms and Conditions of Sale

Online, telephone, showroom and proforma orders

Published by VIVERE FURNITURE LTD | Effective 18 October 2026 | https://viverefurniture.com/

These terms govern contracts for furniture, furnishings and related products sold by VIVERE. Please read them before ordering. A consumer’s statutory rights are not affected.

1. About us and these terms

VIVERE is the trading brand of VIVERE FURNITURE LTD, a company registered in England and Wales under company number 14894563, whose registered office is Flat A2701, 9 Owen Street, Manchester, England, M15 4TQ.

“VIVERE”, “we”, “us” and “our” mean VIVERE FURNITURE LTD. “You” and “your” mean the person or business ordering. “Consumer” means an individual acting wholly or mainly outside their trade, business, craft or profession. “Business Customer” means anyone acting for business purposes.

These terms apply together with the product page or specification, order confirmation, any accepted quotation or proforma invoice, and our Delivery, Returns, Warranty, Privacy and membership policies. If an accepted written quotation expressly conflicts with these terms, the quotation prevails only for that point.

2. Product and order classifications

  • Ready to Deliver: stock or otherwise available for dispatch within the stated availability window.
  • Made to Order: manufactured or sourced after order. It is not automatically bespoke; the Returns Policy explains when statutory cancellation rights apply.
  • Custom Made or Bespoke: made to your specifications or clearly personalised, including non-standard dimensions, finishes, fabrics, configurations or other customer-selected specifications that make the item unsuitable for general resale.
  • Enquiry Only: a product or service requiring a written scope and quotation before an order can be placed.

3. Product information and natural variation

We take reasonable care to present products accurately. Images, room settings, samples and screen colours are illustrative. Dimensions and weights may be approximate within normal manufacturing tolerances. The agreed written specification in the order confirmation or proforma invoice controls.

Natural timber, stone, marble, leather, fabric and handmade finishes vary in grain, veining, texture, shade, pattern and character. These inherent variations are not defects. Fabric dye lots and hand-applied finishes may also differ slightly between orders or samples.

You must check dimensions, orientation, access requirements, finishes, electrical requirements and all other specifications before placing an order. For custom work, approval of drawings, samples or specifications authorises production on that basis.

4. Eligibility and account information

You must be at least 18 and able to enter a binding contract. You are responsible for accurate contact, delivery and billing information and for keeping account credentials secure. Membership is not required to buy unless a particular offer states otherwise.

VIVERE Club accounts are intended for consumers. VIVERE Trade membership is subject to separate approval and terms. Trade membership does not make a personal consumer purchase a business purchase, and a consumer account does not turn a genuine business purchase into a consumer purchase.

5. How the contract is formed

Your website order or signed quotation is an offer to buy. An automated acknowledgement confirms receipt, not acceptance. For Ready to Deliver products, the contract is normally formed when we send an express acceptance or dispatch confirmation. For Made to Order, Custom Made or proforma orders, it is formed when we confirm acceptance in writing and receive the required cleared payment or deposit.

We may decline an order before acceptance, including where a product is unavailable, information or price is incorrect, payment cannot be authorised, delivery is not feasible, sanctions or fraud checks fail, or legal or safety restrictions apply. If payment has been taken for a declined order, it will be refunded.

Changes after acceptance require our written agreement. A requested change may affect price, lead time, availability and cancellation rights. Production may begin promptly after acceptance.

6. Prices, VAT and payment

Consumer website prices are displayed in pounds sterling and include VAT where legally chargeable unless clearly stated otherwise. Trade quotations may show prices excluding VAT. Delivery, installation, customs charges and other services are additional unless expressly included.

We may correct an obvious pricing or description error before acceptance. If we discover an error after acceptance, we will contact you and offer the choice of proceeding at the correct price or cancelling for a refund, except where the price was obviously wrong and could reasonably have been recognised as an error.

Payment must be made using the methods shown at checkout or on the proforma invoice. Deposits, staged payments and balances are due on the stated dates. We may delay production or delivery if payment is overdue. Title to goods passes only when we have received all sums due; risk passes as described in the Delivery Policy.

Discounts are governed by the offer and Membership Terms. Unless expressly allowed, discounts cannot be combined, exchanged for cash, transferred or applied retrospectively. A project quotation or individually agreed price overrides general discount codes.

7. Availability, lead times and delay

Availability and lead times are estimates unless expressly guaranteed in writing. Made to Order lead times begin only after we have received the required payment, final specification and any approvals. Supplier shutdowns, material availability, shipping, customs and access arrangements may affect dates.

We will inform you of a material delay and provide a revised estimate. Consumer remedies for late delivery under applicable law are preserved, including where an agreed essential deadline is missed or delivery is not made within a reasonable additional period set by the consumer.

8. Delivery, access and installation

Delivery is governed by the Delivery and Installation Policy. For Ready to Deliver items, the delivery charge is provided at checkout where supported, or confirmed in writing before an order is accepted. Made to Order and Custom Made delivery is quoted in the proforma invoice after considering the product, weight, location, access, method and urgency.

You must give complete access information, check the route from vehicle to final position, secure permissions and parking, protect floors and remove obstructions. Our acceptance of an order does not guarantee that an item will fit through doors, corridors, stairways or lifts.

Delivery Only and White Glove Delivery & Installation are different services. Assembly, placement, packaging removal, wall fixing, electrical or plumbing work are included only if expressly confirmed. Failed delivery, storage, special access equipment and re-delivery may be charged at reasonable actual cost where the failure is attributable to you.

9. Inspection, damage and shortages

Please inspect the goods as soon as reasonably possible. Record visible packaging or product damage with the delivery team and retain packaging where safe. Report damage, shortage or an incorrect item promptly through the Contact page, ideally within 48 hours, with the order number and clear photographs. The 48-hour request helps investigation but does not remove statutory rights.

Do not arrange repairs, dispose of goods or return bulky items without our instructions. We may ask to inspect the product and may arrange collection, repair, replacement or another legally appropriate remedy.

10. Consumer cancellation and returns

Consumers buying at a distance may usually cancel an order for standard goods within 14 days after delivery and then have a further 14 days to return them, subject to the statutory rules and the Returns Policy. The right does not generally apply to goods genuinely made to the consumer’s specifications or clearly personalised.

A label such as “Made to Order” does not by itself remove the statutory cancellation right. We apply the bespoke exception only where the item is genuinely customer-specific. Business Customers do not have consumer change-of-mind cancellation rights.

Custom or bespoke orders may be cancelled only where we agree in writing or where law requires. Before production, we may agree to cancellation subject to reasonable, evidenced costs already incurred; after production begins, cancellation may not be possible.

11. Quality and statutory rights

For Consumers, goods must be of satisfactory quality, fit for any purpose made known and match their description. The Consumer Rights Act 2015 provides remedies that may include the short-term right to reject, repair or replacement, price reduction or final rejection, depending on the circumstances. Nothing in these terms excludes or restricts those rights.

Our commercial warranty is additional to statutory rights and is described in the Warranty and Aftercare Policy. Product-specific manufacturer warranties apply only where identified in the product page or order confirmation.

12. Business Customer terms

If you are a Business Customer, you confirm that the order is placed in the course of business. All terms implied by sections 13 to 15 of the Sale of Goods Act 1979 are excluded to the fullest extent permitted by law. You must inspect goods promptly and notify apparent shortages or damage within five working days, without limiting rights that cannot lawfully be excluded.

We are not liable to a Business Customer for loss of profit, revenue, business, contracts, anticipated savings, goodwill, data, opportunity or any indirect or consequential loss. Our total aggregate liability arising from an order is limited to the total price paid for that order, except for liability that cannot lawfully be limited or excluded.

13. Liability

We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that law does not permit us to limit.

For Consumers, we are responsible for losses that are a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for business losses arising from a consumer purchase. We are not responsible for loss caused by inaccurate access information, unauthorised installation, misuse, failure to follow care instructions or third-party alterations.

14. Interior design and project services

Design, sourcing, project management, installation supervision and related professional services require a separate written scope, fees, deliverables, assumptions and programme. Product purchases remain subject to these terms unless that service agreement expressly states otherwise. Visualisations and mood boards are design proposals and may not precisely reproduce colour, scale or finish.

15. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, including supplier interruption, shortage, industrial action, transport or port disruption, customs delay, severe weather, fire, flood, epidemic, government action or network failure. We will take reasonable steps to reduce the effect and contact you where the event materially affects your order. Mandatory consumer rights remain available.

16. Website and intellectual property

Website content, photography, text, designs, trade marks and other material are owned by or licensed to VIVERE. They may be used for personal shopping or approved trade project purposes only. Scraping, resale of content, misleading association, or commercial reproduction without written permission is prohibited.

17. General legal terms

We may transfer our rights and obligations where this does not reduce consumer protections. You may transfer yours only with our written consent, except where law permits. If any provision is invalid, the remainder continues. Delay in enforcing a right is not a waiver. Only the parties may enforce the contract.

We may update these terms for future orders. The version accepted when your contract is formed applies to that order.

18. Governing law and complaints

These terms and contracts are governed by the law of England and Wales. Consumers living elsewhere in the United Kingdom retain any mandatory protections of their home jurisdiction and may bring proceedings in the courts available under applicable law. Business Customers submit to the exclusive jurisdiction of the courts of England and Wales.

Please contact us first so we can try to resolve a complaint fairly. Nothing in this section limits any right to use a court or legally available dispute-resolution route.
